USA Supreme Court on Roe vs Wade

By now, you have likely heard the news that there is a leaked USA Supreme Court document that will overturn the landmark 1973 Roe vs Wade decision.

This post is not about abortion, or the rightness or wrongness of either the 1973 decision or the possible reversal.

This post is about the non-sensical statement made by Supreme Court Justice Samuel Alito. 

“The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision” 

He is right. 

  • There is nothing about abortion in the ~4,000-word USA Constitution crafted by 55 men in 1787. 
  • There are a lot of things not written about in the USA constitution.
  • Women did not have legal rights under the constitution until 1920 (19th Amendment).
  • When the 14th Amendment was passed in 1868, it was intended to give former slaves equal protection and voting rights under the law; it was not meant to protect women. In fact, it specified equality for male slaves, female slaves were excluded as were all women, regardless of race.
Maybe he needs to take History 101. He obviously missed it the first time around. Or maybe, the USA Supreme Court is not about ruling on laws, but about being political.
